Note The goods must be properly and completely cleaned, decontaminated and made safe to handle before they are sent to KJLC unless a decontamination plan has been made and agreed upon with KJLC.

KJLC Services, Warranty Evaluation, & Returns Policy:

By checking the box at the end of this Policy, you confirm that you agree as follows:

Services (if applicable):

  1. By submitting your goods for non-warranty services such as repair, reclaim, maintenance, calibration, or bonding (collectively "Services"), you agree to Kurt J. Lesker Company's ("KJLC") Standard Terms and Conditions of Sale LEF-203 ("LEF-203"). LEF-203 is available on our website at lesker.com and shall apply to your purchase of Services from KJLC. LEF-203 is incorporated herein by this reference.

Warranty Evaluation (if applicable):

  1. KJLC reserves the right to determine, in its sole reasonable discretion, whether your goods are eligible for a warranty repair.

Returns (if applicable):

  1. KJLC reserves the right to determine, in its sole reasonable discretion, whether your unused, unopened goods are eligible for return. Upon receipt of your goods, if they are not in their original packaging and/or KJLC believes, acting reasonably, that the goods have in fact been used, KJLC shall have the right to return the goods to you at your cost.

Miscellaneous (generally applicable):

  1. KJLC will not accept your goods unless and until we issue to you a Return Authorization Number.
  2. You are responsible for packaging and/or crating the goods that you send to KJLC to ensure proper transit and to prevent shipping damage. Further, it is your responsibility to ensure that the goods are packaged in compliance with applicable federal, state, and/or local laws when shipping to KJLC. For the avoidance of doubt, the risk of loss of the goods shall rest with you at all times during transit both to and from KJLC's facility.
  3. You certify to KJLC that (i) all information provided in or with your Return Authorization Request is true and complete; (ii) to the extent that the goods were used with or contained any hazardous or toxic materials, those goods have been decontaminated and made safe to handle prior to sending to KJLC; and (iii) to the extent that the goods contained fluids, such fluids have been completely drained and any fluid reservoirs have been sealed.
  4. If (i) KJLC has attempted to contact you after receipt of your goods and you do not respond to KJLC within ninety (90) days thereafter; or (ii) without limiting or waiving any other rights available to KJLC under the law, if payment is due from you to KJLC in relation to your goods and such payment has not been received by KJLC as of thirty (30) days from the original due date for such payment, then in either case KJLC reserves the right to determine the disposition of the goods in any manner that we deem appropriate.
  5. KJLC relies on the accuracy and completeness of your answers on the Return Authorization Request in order to protect KJLC employees and to comply with applicable laws, as well as to determine whether to issue to you a Return Authorization number and/or to accept the goods. By checking the box below, and without limiting or waiving any remedies available to KJLC under the law, you hereby accept full responsibility for, and agree that you will indemnify, defend, and hold harmless KJLC and its employees, agents, and all other persons from and against, any harm, injury, loss or expense arising from or out of (i) the condition of the goods that you send to KJLC; or (ii) any inaccuracy, incompleteness, or misrepresentation made by you in the Return Authorization Request.
  6. In the event that the goods are damaged or lost while in KJLC's possession, including for reasons beyond KJLC's control, KJLC shall use commercially reasonable efforts to procure replacement goods of an equivalent nature and value. In such a situation, you shall remain liable to compensate KJLC for the replaced goods but only up to an amount equal to the estimated value of the services and/or repairs that would have been needed to bring the original goods into working condition.
  7. KJLC complies with all applicable export controls. Export control laws and restricted parties can change at any moment. The goods and/or the end user to whom the goods are to be sent after service or repair may be or become subject to export restrictions. KJLC shall have no liability to you or to any other party if KJLC is unable to return the goods to you or to the party to whom you direct shipment if export restrictions on the goods and/or the intended end user or end use destination apply.
  8. Failure by you to comply with all applicable aspects of this Policy and any instructions or directions given to you by KJLC with respect to the return of the goods may result in delays to services and/or repairs.
